摘　　要：凡冤案之形成,无不可以追溯至侦查阶段。检讨佘祥林冤案,亦应关注冤案的起点———侦查错误。本文从侦查认识、侦查法治两个维度,对佘案中的侦查错误予以剖析,并就提高侦查防错、纠错能力提出建议。通过剖析,深刻认识到:科学与法治是侦查工作的灵魂。We can find the miscarriage of Justice often arise from investigation error from the analysis of the causes. Therefore, when reflecting the case of She Xianglin, we must give our attention to the origin of the case--investigation errors. This article analyses the investigation errors of She Xianglin case from epistemology and law. and tables some proposals on the prevention and correction of investigation error. Through the analysis, we can draw an important conclusion： science and law are the soul of the criminal investigation.
