建立建筑业农民工工资支付长效保护机制的思考

摘　　要：拖欠建筑业农民工工资不仅是个法律问题,更是个社会问题。它集中表现为工资支付机制不健全和行政机关执行不力,主要原因在于立法和司法指导思想上缺乏建立工资支付长效保护机制的考虑、政府角色错位、建筑市场运行不规范以及农民工就业压力巨大。应当通过整合立法,建立建筑业农民工工资支付的长效保护机制,并通过加强执法将长效机制落到实处。Default payment of peasants-workers has been not only a law problem, but a social one. It concentrates on payment mechanism distemperedness and executive problem. The main reasons are included that there is no deep thought of on the loug-effective payment mechanism in legislation and justice idea, that the role of the administration is inaccuracy, that the operation of construction industry ruled by law partly, and it exists large employment pressure for peasantsworkers. So the follow measures should be taken, including legislation conformity, establishment long-effective payment mechanism for peasants-workers, and carrying the former out by powerful execution.
