摘　　要：由陪审团审判是美国宪法规定的一项重要的权利,陪审制在美国司法制度中有着举足轻重的地位。美国的陪审团分为大、小陪审团两种,它们在实际运作过程中既承担着民主政治的功能,也体现了保障公众参与司法、尊重当事人的程序性选择权、推进完善证据规则等法律制度功能。并且陪审制的良好运用,对律师用有激励作用,对法官有制约作用,对社会则可起到缓和、抚慰作用。Trial by jury is an important right authorized by and the U. S. Constitution, and the jury plays a decisive role in the American judicial system. There are two types of jury： the grand jury and the petit jury. in practice, jury system undertakes a political task of democracy, and also bears the judicial responsibilities for guaranteeing the public participation in judicial action, respecting the option fight of the litigant, and improving the evidence rules. A good jury system can encourage the lawyer, restrict the judge and console the society.
