关于高校学生权利救济制度几个问题的探讨

摘　　要：随着我国法治的进步,高校学生维权意识的增强,依法治校的呼声已越来越高。为适应这一时代要求,教育部新近出台的《普通高等学校学生管理规定》首次对学生的权利和权利救济制度作了明确具体的规定。对学生权利和权利救济制度中的几个问题进行了较为深入全面的探讨,提出和论述了学生申诉的范围、申诉的受理机构、申诉的审理程序,这三方面的内容构建高校学生权利救济的一个独特、崭新的理论。It is becoming more and more urgent to administer colleges and universities by law as the rule of law progresses in China and students＇ awareness of right protection is enhanced. To meet the demand of the times, the Ministry of Education has enacted Provisions on the Administration in Regular Institutions of Higher Education which, for the first time in China＇s history, has made definite and specific stipulations concerning the right and right redress of students. This paper discusses several questions in this area and elaborates, in particular, on three aspects of the issue - the scope of appeals, the administering body and the hearing process, which constitute a unique and brand new theory of right redress for college and university students.
