摘　　要：和谐社会正在成为当下中国社会转型时期的目标和主题,然而无论从过程亦或结果而言,紧张与冲突将是扣谐社会构建中的主要现象,尤其在社会经济、政治结构转型的时代。法治的超前和理性,是协调这种紧张与冲突的基本调控方式,且应是和谐社会实现可能的基础和必经之途。Harmonious society is becoming the goal and theme in this social transitional period of China. However, with regard to process or result, tensions and conflicts will be the main phenomena in the construction of harmonious society, especially in the transitional period of social economic and political structure. The proacfive nature and justice of legal system is the basic factor that can coordinate this tensions and conflicts and should be the foundation of and approach to the realization of harmonious society.
