摘　　要：环境侵权损害赔偿中的财务保证制度作为一种将本应由个体承担的环境侵权损害赔偿转由多数企业或者社会上多数人承担和消化的环境侵权损害赔偿法律制度,在国外环境侵权损害赔偿实践中有着重要的作用。文章在对财务保证制度的定义、表现形式和法律特征进行分析的基础上对财务保证制度与相类似的环境押金制度进行了深入的比较,并以日本矿业法为例,对财务保证制度的适用范围、财务保证基金的收取标准及其实施进行了探讨,以祈对我国有一定的借鉴作用。Financial guarantee system for environmental tort damages diverts environmental tort damages to the majority of enterprises or individuals in the society, while the damages should be borne by individuals. The system takes an important place in the foreign practices. The thesis not only analyzes the definition, manifest and legal characteristic of financial guarantee system, but also makes a thorough comparison between the system and environmental deposit system on that basis and taking Japan mining law for example, the thesis discusses its scope of application, charge standard and implement of financial guarantee fund in order to provide references to the relative systems in our country.
