摘　　要：本文对现行刑事诉讼法赋予检察机关不起诉裁量权的制约机制作了全面概括与利弊分析,并提出了完善思路。The paper summarizes the restraining mechanism of non - prosecutorial discretion entrusted to the procuratorial organ by the present criminal procedure law and analyses its advantages and disadvantages, and then puts forward the improving ideas.
