解读《物权法(草案)》对土地承包经营权的物权化改造

摘　　要：保护农民的合法权益,切实解决“三农”问题是目前中国社会急需解决的问题。而选择一种合理的土地产权制度又是解决问题的关键。本文以新出台的物权法草案为依据,通过对农村土地承包经营权物权化改造的分析,力图构建一种合理有效的土地产权制度,为社会的发展尽绵薄之力。文章主要包括土地承包经营权物权化改造的内容及几点立法建议。Protection of the peasants legal rights and the resolution of the Sannong issues shall be emergency of China society. However the choice of the reasonable system of the land and the assignment is the key of the resolution. In the paper, basing on the draft of the China Property Law, via the studies on the village land cooperation of land property reformation, the new re - structure will be created to achieve the society as possible as I can. The paper main contents include the background of and the legal system of the village land cooperation of land property reformation and so on.
