摘　　要：对盗窃信用卡并使用的行为如何定性在刑法学界存在着较多的争论。盗窃信用卡并使用的行为的定性应当具体情况具体分析,在刑法中并没有对此予以硬性规定的必要。There is more dispute that how to determine the nature the behavior of stealing the credit card and using in the punishment law circles, theorists especially analyze the meaning of ＂steal＂ and ＂using＂ behavior on the basis of commenting view of every experts, and draw the conclusion, Namely behavior of stealing the credit card and using should determine the nature the concrete conditions are made a concrete analysis of, there is not given rigid and fixed necessity to this in criminal law.
