摘　　要：都市边缘群体———农民工的问题是当前社会较为关注的热点问题。作者从农民工社会保障立法的缺失与不足入手,深入剖析与探讨其困境成因后指出,正是我国社会保障立法对农民工需求的供给不足或不能有效供给,才导致社会保障制度立法对他们群体社会保障权利的漠视与忽略,并从农民工社会保障立法路径选择和制度体系安排的出路方面,分核心、基础、辅助三个层次作了理论探讨。The question of rural workers, a group living on the edge of cities, is a hot topic. Therefore, the authors start with the present legislation situation that the group on the edge of cities——the rural workers——can＇t enjoy the society safeguards. And with thorough analysis, the authors point out that it is just because the lack of main body status of rural workers in society security, which causes the legislation of society security system safeguards to ignore and neglect the rights of this group,and it leads rural workers＇ rights in society security on the edge, too, just like their living status. Thus, it is necessary to examine the status of rural workers in the present social security system carefully again, and establish their proper status as the main body in social security.
