论司法审判能力对法律局限性的矫正与弥补

摘　　要：现代社会中的法律因其具有其他社会控制手段所无与伦比的技术可操作性而成为最佳的社会关系调整器,但法律在创制、运作以及对社会关系的作用等方面,也存在着固有的内在局限。要使法治社会中的法律得以良性运作,需要法官以独有的法律思维、解释法律、适用法律等司法审判能力矫正和弥补法律的局限性,确保法律的权威性和效益性,最大限度地发挥法律的内在功能。In modem society, law has become the best regulator of social relation for its incomparable technic operation than other social control means. However, in many aspects including making, operation and function on social relation , law exists inherent localization. In law society, in order to operate law very well, need judge use particular judgement capability including law thinking, interpreting law, operating law to remedy law localization , insure law authority and benefit, exerting legal inherent function.
