摘 要:无单放货案件是指海运承运人及其他相关行为人未收回止本提单,擅自将提单项下货物放给无权提取货物的人,提单权利人向有管辖权的法院起诉并主张提单权利的案件。长期以来,无单放货纠纷在国际航运中居高不下,在海事诉讼中占有较大比重,正确处理这类案件对促进国际航运、经贸事业的发展具有重要意义。本文拟结合我国海事审判实践,仅就无单放货案件的法律适用、诉讼时效谈点浅见。Acase of delivery of goods without presentation of original bills of lading refers to a case in which the carrier and other related parties under a contract of carriage by sea fail to take back the original bills of lading and deliver the goods under the bills of lading to the party unauthorized to take delivery, and the right holder of the bills of lading has the right to bring an action in a court with jurisdiction to claim the rights under the bills of lading. For a long time, the disputes over delivery of goods without presentation of original bills of lading have occurred the most in international carriage by sea, and accounted for a large proportion in maritime litigation. The correct handling of these cases is of great significance in promoting the development of international carriage by sea and trade. This article attempts to offer a preliminary view on the application of law and limitation of actions in cases of delivery of goods without presentation of original bills of lading, in combination with the maritime judicial practice in China.
