摘　　要：近年来,随着高层建筑物、居住小区的大量出现,物业管理行业发生了许多具有影响性的事件,如小区内业主伤亡、公共设施权益纠纷、物业管理纠纷等,都对物业管理立法提出了挑战。本文将在剖析物业管理合同法律性质的基础上,对物业管理法律关系进行理论与司法实践上的解析,期望能够对物业管理的行业发展有所裨益。In recent years,along with the appearance of high buildings and apartment communities,A lot of affairs have taken place among the property management trades,for example ,the casualties of owners,the right and interest difssensions that based on commonality establishments,the dissensions of the property management,and so on.hese will challenge the legislation of the property management.Base on the analysis of the legal character of condominium contract,this article will research on the legal relations of the property management from the angles of the theory and judicature practice for the development of the property management trades.
