摘　　要：国内外立法中均有后合同义务的规定。后合同义务与合同给付义务、合同约定义务、先合同义务有着显著区别。后合同义务包括通知义务、协助义务、保密义务、照顾义务、不得同业竞争义务等内容。违反后合同义务的法律责任是不同于缔约过失责任、违约责任、侵权责任的一种独立的民事责任,其承担方式有损害赔偿和实际履行,赔偿范围为实际损失。The prescription of the duty of the post- contract exists in lcglslation both at home and abroad. The duty of the post- contract is obviously quite different from the contract given duty, the contract assumpsit duty and the pre- contract duty. The post - contract duty involves duty of notification, duty of giving assistance, duty of keeping secret, duty of care and duty of no competition in the same industry and so on. The legal liability of defaulting the post - contract duty is different from an independent civil liability including contracting fault liability, defaulting liability and tort liability. The way of execution consists of loss compensation and actual performance, and the scope of compensation is actual losses.
