摘　　要：本文从分析中外合作经营企业先行回收投资的条件和方式出发,对现在的关于先行回收投资性质的学说进行简要评述,提出实践中合作经营企业先行回收投资应当注意防范的一些风险。This article begins by analyzing the qualifications and modes of recovering foreign investment ahead of Time in Chinese-Foreign Contractual Joint Ventures. After reviewed the legal nature of present doctrines on recovering investment ahead of Time, this article will bring forward several risks deserved our attention in practice .
