摘　　要：房屋租赁登记备案制度,是国家为了加强对房地产租赁市场的管理而设立的。该制度规定房屋租赁实行登记备案制,房屋主管部门颁发的房屋租赁证是租赁行为合法有效的凭证。随着时间的推移,该项制度的缺陷逐渐显现出来,因此有必要对租赁登记的法律效力、性质、在司法实践中如何适用进行探讨。House tenancy register records system is designed by the state to strengthen the administration of the real estate tenancy market. The system goes house tenancy register records and House Tenancy Cetrificate are legal and valid for tenants＇ renting. As time goes, the disadvantages of the system gradually reveal, so it is necessary to probe into the legal effec4 quality, and how to practice it.
