利益平衡视角下的民间文学艺术保护

摘　　要：民间文学艺术作为传统文化的重要组成部分,日益成为知识产权领域关注的热点。尽管发展中国家积极通过法律手段保护民间文学艺术,但是并没有得到世界上大多数发达国家的认同,民间文学艺术的国际保护正面临困境。本文从利益平衡的视角探讨如何协调各国利益,构建民间文学艺术的国际保护体系。As a major part of traditional knowledge, folklore is becoming an important issue within the intellectual property field. Many developing countries actively protect folklore by legislation, which, however, has not gained the recognition of most developed countries. This article suggests building a new international system to protect folklore on the basis of balancing the interests of different countries.
