摘　　要：目前的社区矫正工作是在现行法制框架下进行的,不可避免引致一些在现行制度下无法解决的问题。社会服务刑的自身功能决定了它应当是我国社区矫正制度的主要内容之一,设置社会服务刑是完善我国罪犯矫正体系的需要,是行刑社会化的必然要求。community -based corrections are subject to present legal frame, and some unsolvable problems caused in the present system is unavoidable. The function of Community Service Sanction determines that it is one of the main contents in our country＇s community - based corrections system. To construct Community Service Sanction is to perfect our criminal rectification system, and it is the necessary requirements for punishment socialization. Community Service Sanction will legalize the Community rectification system and carry it out. Community Service Sanction should be constructed according to the pattern of the Criminal Law Amendment Act and perfect our community - based corrections system.
