WTO绿色规则与MEAs(多边环境条约)协调之分析

摘　　要：贸易与环境必须协调发展已成为人们的共识,但是涉及贸易与环境的WTO规则与多边环境条约(MEAs)之间的关系应怎么协调成为人们面临的现实问题。WTO绿色规则与多边环境条约(MEAs)在PPM s标准、实施贸易措施的方式等方面存在着冲突。为了协调两者之间的关系,可以建立一个WTO秘书处与MEAs秘书处之间的合作机制促使两个不同性质的机构相互了解,探讨或磋商协调的方法;从保护环境的角度出发,可以在WTO体制中确立优先适用MEAs的标准;在实践中,运用WTO争端解决机制来协调两者发生的纠纷以及允许并确保非政府组织的参与;在一定条件下,签定一个关于履行多边环境条约而采取贸易措施的协议来协调两者的关系。Trade and environment must coordinate development,which has become people＇ s common recognition , but the relation between WTO rule concerned with trade, enviroment and MEAS how to coordinate to has become the realistic problem that people are faced with. WTO green rule and multilateral environmental treaty （ MEAs ） existence conflict in PPMs standard and the enforcement aspects such as the way of trading measure. To coordinate the relation between two , it can establish a cooperative machine made organization between WTO secretariat and MEAs secretariat that makes the two different qualities of the mutual understanding, discuss or consult coordinative method; From protecting environmental angle, it can establish the standard of prior suitable MEAs in WTO system; In practice, it utilizes the WTO dispute as well as promise that solves mechanism to coordinate two to occur and ensure non-government organization to participate in; Under certain condition, it signs an agreement about performing multilateral environmental treaty to adopt the relation of coordinative two.
