摘　　要：从对民事责任制度的正当性的考察入手,分析了中西方法律文化对民事责任公正性的不同认识模式,进而提出一种以社会为基础的民事责任理论。This paper based on a study and research of the concept of ＂justness＂ under a civil liability system, analyzed and compared different understandings of the concept of ＂justness＂ between Chinese and Western legal cultures and traditions and then put forward a social based civil liability theory.
