摘　　要：经济法对促进和保障科技创新具有重要作用,要使这些作用得以充分发挥,必须转变政府职能,确立企业的科技创新主体地位,完善政府在科技创新中的宏观调控功能,制定专门的《科技创新法》,完善反不正当竞争法,全面保护知识产权。Economic law has an important role on the promotion and protection of scientific and technological innovation, government functions must get transformation for the role into full play, we should establish enterprises status of technological innovation, improve the scientific and technological innovation in the macro -control function of a specialized ＂Technology innovation Act,＂ make anti - unfair competition law, and give intellectual property rights the full protection.
