解决土地信访问题的法学思考

摘　　要：近年来由于土地权利人合法权益得不到保护而引发的土地信访事件急剧增加,给经济社会发展带来了不安定因素,引起了中央高度重视。文章从法律的视角分析了土地信访的现状与问题,揭示出法律冲突、利益冲突以及涉及的两个“两难”选择是导致当前存在问题的主要原因,最后有针对性地提出解决土地信访存在问题的四个“相结合”的具体对策。In recent years,because the legitimate rights and interests of the obligee of land can not be obtained protection,the cases with regard to Land Petitions in the Form of Letters and Visits is increasing strongly,which caused destabilizing factors to the development of society and economy.And this situation has attracted highly attention of the central government.Based upon the analysis on the current situation and problems of Land Petitions in the Form of Letters and Visits from the point of law,the paper argues that the reasons behind the problems lies in the fact that: conflict of law and conflict of interests,and given this situation the paper discusses some specific methods for dealing with these problems.
