摘　　要：中国当代信访制度的雏形出现于上世纪五十年代初,从那时起它作为表达民愿、参与政治和解决纠纷的一种特殊手段,在化解社会矛盾、稳定社会秩序方面发挥了重要的作用。信访制度是中国特有的一种人权救济方式,它的功能也是随着时代发展而不断变迁。但是近几年来,由于信访体制不顺,机构庞杂;信访功能错位,责重权轻;信访程序缺失,立案不规范以及信访人的法律救济意识淡薄等诸多原因,致使信访作为一种非诉救济方式却很难再实现其化解纠纷、救济权利的目的。因此,在新的历史条件下,需要对信访制度进行必要的反思和重构,不断规范信访制度,通过对中国古代、近代信访制度的考察,进一步探讨中国信访制度的运作模式。The Chinese present age inquiry system embryonic form appears in the beginning of 50＇s this century, since then it took expresses the people to hope, the participation politics and the solution dispute one special method, was melting the society to be contradictory, the stable social order aspect has played the vital role. The inquiry system is the Chinese unique one human rights relief way, its function also is along with the time development but unceasing vicissitude. But in the last few years, because the inquiry system is not suitable, the organization is numerous and disorderly; The inquiry function dislocation, the responsibility heavy power is light; The inquiry procedure flaw, does not put on record the standard as well as inquiry person＇s legal relief consciousness light and so on many reasons, causes the inquiry to take one kind must sues the relief way very to be actually difficult to realize it to melt the dispute, the relief right goal, Therefore, under the new historical condition, needs to carry on essential reconsidering and the heavy construction to the inquiry system, the standard inquiry system, through to China ancient times, the modern inquiry system inspection, further discusses the Chinese inquiry system unceasingly the operation pattern.
