论纺织服饰工业品外观设计的工业版权保护制度

摘　　要：我国根据WTO／TRIPS协议要求已经修改了知识产权法,但对于WTO／TRIPS协议规定的纺织品外观设计保护这一问题还没有明确规定。在权衡欧洲及美国对纺织品等工业品外观设计的法律保护模式的基础上,建议确立一种区别于现有工业产权和著作权的权利——工业版权制度对其进行法律保护,并制定具有世界领先水平的工业版权法。China has modified its intellective property right law according to the agreements of WTO/TRIPS, but the protection of textile appearance design in legislation which is particularly emphasized by the agreements of WTO/TRIPS is not regulated obviously. So by weighing the protective modes of legislation about textile appearance design in many countries, the author suggests that our country should enact a world-level advanced law, which is different from industrial property right law and copyright law, to protect it. Besides, the author also states on industrial copyright system initially, by taking textile appearance design for example, in three aspect： the necessity of completing legal protection of industrial product appearance design, the legal mode of industrial product appearance, and the design study on industrial copyright law used in industrial product appearance design.
