摘　　要：本文通过对空间利用权之概念、特征、性质及其存在条件的分析探讨了空间利用权与空间权之区别及其与土地所有权和土地使用权的关系,针对我国有关立法的现状,提出我国物权法对核心物权土地权利的规定应考虑未来实践发展的需要。Based on the analysis on the concept, characteristics, nature and the conditions of the presence of the right of access to space, this article focuses on the differences between the right of access to space and the right of space, and the relationships between the right of access to space and the land ownership, the land-using right. In view of the current situation of China＇s relevant legislation, this article puts forward the idea that the stipulation of the key land rights in China＇ s Property law should take into account the needs of future practical developments.
