摘　　要：医疗者未尽合理注意义务,而使得残疾儿“不当出生”,父母因此享有医疗损害赔偿权。“不当出生”不是价值实现,而是损害事故,其请求权基础可以是违约责任或侵权责任。损害赔偿范围包括机会利益的损失,反差利益的损失、人格利益的损失以及对“不当出生”的残疾儿的抚养费。Parents possess medical indemnity right if ‘ wrongful birth’is due to that medical professionals haven＇ t fulfilled reasonable attention obligation. ‘ Wrongful birth’ is injury accident rather than worth realization. Parents＇ indemnity claim may be based on liability for breach of contract or liability for tort. The compensation should cover loss of opportunity, loss of contrast benefit, loss of personality benefit and fees for bringing-up the wrongfully born.
