运动员肖像权保护的法律分析——从个案引申出来的法律问题谈起

摘　　要：肖像权是我国法律规定的每个自然人所享有的一项权利,受法律的保护,不容侵犯。有些较知名运动员无疑是社会公众人物,其形象为社会大众所熟悉,其行为也会带来一定的社会效果,所以从这个意义上来说,运动员的肖像权的保护就有了一定的特殊性。文章通过对国内一起著名的运动员肖像权诉讼案件的分析,指出了在我国运动员的肖像权应属于个人,集体肖像权也应在今后的立法中作出相应规定,并提出了在我国运动员维护其肖像权的途径。The right of the portrait is that each natural person of the legal provisions of our country enjoyed a right, receive the protection of the law, can＇t infringe. Some more famous sports athletes are undoubtedly the public persons , its image is known by social masses, its behavior will bring certain social effect too, so in this seuse, the protection of the sports athlete＇s portrait right has certain particularity. The article is passed to the analysis of weighing the case of the domestic famous sports athlete＇ s portrait, point out portrait right, sports of athlete should belong to individual in our country, collective portrait right should make the corresponding regulation of the legislation in the future too, put forward in athlete, sports of our country, maintaining their portraiting waying of right.
