摘　　要：商业秘密侵权救济制度是强是弱,对于商业秘密权利能否得到有效保护极为重要。我国商业秘密侵权救济制度的相对弱化,严重束缚了商业秘密保护效能的发挥,对商业秘密没有起到应有的保护作用。学习、借鉴美国《统一商业秘密法》的有益经验,增设我国商业秘密禁令和潜在侵占救济制度,不失为强化我国商业秘密侵权救济的路径选择。The strength of the relief system for enterprises involved in torts of trade secrets plays an important role in the effective protection against the torts of business secrets. China＇s relief system is relatively weak, thus it severely affects the due protection of trade secrets. So we believe that it is a good alternative for strengthening our relief system for businesses in the torts of trade secrets by learning from the American ＂Uniform Trade Secrets Act＂ and establishing our own trade secret bans and relief system for potential torts of trade secrets.
