摘　　要：在体育领域讨论法律运作问题,必须以我国当前的现行法律为依据,从观念上消除体育行业规则与国家法律之间存在的冲突,进而对涉及的具体法律问题进行现实的分析,并探索法律运作的具体途径和方法———体育公益诉讼,为司法权力介入体育领域内的违法行为提供程序法上的有力支持,从而为实现我国的体育竞技活动公平健康的发展,提供一种基于现实法律制度的可能性。The paper points out that in order to discuss the law operation in sports, it should be based on present law in China and eliminate the conflict between sports industry rules and national law, and further to analyze the relevant concrete lawsuits and explores concrete way and method as public welfare lawsuit in sports. It will provide powerful support for judicial power to intervene into illegal behavior in sports so as to achieve the healthy development of Chinese comoetitive sports, and it will offer a possibility based on present legal system.
