摘　　要：对于继承契约,世界各国存在肯定和否定两种立法态度。我国继承法没有规定该制度,但将继承契约纳入我国民法典并无理念上的障碍。我国未来民法典有设立继承契约制度的必要性。因此,笔者建议将继承契约制度纳入未来民法典继承编并提出立法建议。Some countries negate the contract of succession, the others approve it. Our present inherits law still lacks the rule, but approving it has no barrier. Our future civil code has the necessity to accepting the rule. So the author suggests that we should take the rule to the future civil law and proposes some legislation suggestions.
