知识产权国际保护标准的解读与启示——以利益平衡为视角

摘　　要：不断强化的全球知识产权保护体系制约了包括中国在内的发展中国家最优知识产权保护政策的制定。转换视角,运用法哲学与经济学的分析方法,正视发达国家过度追求经济利益与发展中国家追求发展之间的尖锐矛盾,正视现实中激励创造与保护公益间的失衡,理解与运用以《与贸易有关的知识产权协议》为核心的现行知识产权国际保护标准,恰当解释现有规则,制定我国最优知识产权实施政策,探究维护我国知识产权利益有效路径,是我们的明智选择。The increasingly strengthened global system of ed the formulation of optimum IPR-protecting policies in protection for intellectual property has restraindeveloping countries with China included. If changing perspective to analyzing methods of legal philosophy and economics, we will face the reality of the intense contradiction between developed countries＇ excessive pursuit for economic benefits and developing countries＇ development as well as the imbalance between encouraging innovations and protecting public interests. It is also a wise choice for us to appropriately understand and apply the current standards of international protection for Intellectual Property with the core of TRIPS and appropriately explain the current rules in order to formulate the optimum intellectual property-protecting policies and to explore effective ways to protect interests of intellectual property in China.
