摘 要:在建设社会主义市场经济的当代中国,侵害商主体商誉权的案件经常发生。我国目前立法中商誉权的法律性质并不明确,对商誉权保护的相关条文亦有不足或相互矛盾之处,不能有力地保护商誉权的权利主体。商誉应是商主体的名誉,商誉权即是商主体的名誉权,属于商事人格权的范畴。对于侵害商誉权的行为,侵权者应当承担停止侵害、消除影响、恢复商誉、赔偿损失、赔礼道歉的民事责任及相应的行政、刑事责任。In the contemporary China that is developing the socialism market economy, it usually occurs the infringement of the fight of good - will of commercial bodies. Because the nature of the fight of good - will isn' t clear and definite in the Chinese current legislation and the related articles of protection of the right of good - will is of lack and contradictory, the current legislation can't protect commercial bodies of the fight of good - will effectively. The good - will should be the reputation of commercial bodies, and the fight of good - will should be the fight of name of commercial bodies and belong to the commercial fight of personality. As to the behavior of infringing the fight of good - will, the infringer should bear the civil responsibility of stopping violiating, dissolving the influence, recovering the reputation, paying for the loss and extending a formal apology and the corresponding administrative and criminal responsibility.
