摘　　要：以法限权和以权限权是法治国家控制侦查权的具有普适性的经验,尽管在强化打击犯罪能力的全球背景下这一经验正面临着挑战。中国侦查程序中的某些制度虽然与西方的经验不尽一致,但这些本土经验在一定程度上也体现了控制侦查权的精神,其控权效果不容忽视。因此,中国侦查程序的改革应当以融合域外经验与本土经验为路径。In legalized nations, controlling power by law and controlling power by rights or power are common experience, which meet serious challenge from the global trend of strengthening the ability to strike crime. Though not in accordance with Western experience in some aspeats, the local experience reflects the control of the power of investigation and its effects can not be ignored. Consequently, the approach of investigation procedure reform in China is to integrate the experience of the West into local situations of China in accordance with the global trend of criminal justice reform.
