摘 要:中国-东盟自由贸易区(CAFTA)争端解决机制是《中国与东盟全面经济合作框架协议》及其各项经济协议顺利履行的重要保障。通过比较分析,该机制在管辖制度、磋商程序、救济措施、争端解决机构及预警机制等方面还存在缺漏,应当借鉴WTO/DSU、NAFTA、ASEAN及亚太地区新兴双边FTA的相关规定加以完善。随着CAFTA进程的深入和各成员对采纳法律方法解决争端的共识的不断增加,CAFTA可以建立、发展和逐步完善司法化或准司法化的争端解决机制。The dispute settlement mechanism of CAFTA is of great importance to secure smooth performance of the Framework Agreement of Comprehensive Economic Co-operation Between the Association of South East Asia Nations and the People' s Republic of China and other relevant economic agreements. However, after a comparative analysis of the mechanism, one can find defects in its regulative institution, consultation procedures, remedy measures, dispute settlement bodies and pre-warning system, etc. As such, it should be improved by way of incorporation of relevant provisions from the WTO/DSU, NAFTA, ASEAN and the new bilateral FTA in the Asia-Pacific region. Along with the development of CAFTA and all its members representing consensus of opinion that disputes should be settled legally, CAFTA should build, adjust and gradually improve its judicial or quasi-judicial institutions to settle disputes.
