摘　　要：法治是和谐社会的根本,依良法而治更是实现和谐社会奋斗目标的关键。刑讯逼供行为古已有之,且大有屡禁不止的趋势。造成刑讯逼供行为泛滥的原因林林总总,但是与刑事法律规定的不完善不无关系。以侦查程序构造为视角,分析侦查程序构造的缺陷对侦查中刑讯逼供行为的影响,通过对侦查程序构造的重构来实现对侦查中刑讯逼供行为的控制。Ruling by law is the foundation of a harmonious society. Ruling by good law is the key to realizing the aim of building a harmonious society. Extorting a confession by torture has existed from history and tended to be from bad to worse. Reasons to such situation have been various, but one reason might be that it has something to do with the imperfection of the criminal law. From the perspective of the structure of spy procedure, this article analyzes how the imperfection of it affects the behavior of extorting a profession by torture and makes the conclusion that the behavior of extorting a confession by torture can be controlled by the reconstruction of the spy procedure.
