对我国旅行社责任保险制度的思考

摘　　要：为了分散旅行社责任风险,维护旅游者利益,国家旅游局于2001年实行强制的旅行社投保责任保险制度,该制度实施5年来,其效果与旅游局的初衷、旅行社的期望相去甚远,有关旅游事故纠纷的报道仍然不绝于耳。本文正是在这样的背景下对我国现行旅行社责任保险制度存在的主要问题进行分析,同时提出发展我国旅行社责任保险的思路和对策,以期促进我国旅行社责任保险的健康发展。To reduce the responsibility and risk of travel services and to safeguard the tourists＇ interests, China National Tourism Administration and Legislative Affairs Office of the State Council implemented compulsory liability insurance system in travel services in 2001. However, the results have not come up to the expectation of the tourism bureaus and travel services since the system was carried out five years ago. Reports about tourism disputes are frequently heard. This paper makes an analysis of the main problems existing in the present-day liability insurance system and also puts forward some thoughts and countermeasures to promote the healthy development of China＇s liability insurance system in travel services.
