摘　　要：村民自治权的组织框架是村民自治权实现的依托。“广西兴安县金石乡中洞村修水电站纠纷案”暴露了村民委员会在村民自治中权力过于集中、对权力缺乏制约等现行村民自治权运行的缺陷,这种缺陷是引发村民委员会侵犯村民自治权的根源。“权力的合理分工及相互制约是权力正常运行的前提”这一蕴涵于现代公司制股东权实现过程中的理论同样适用于作为社会公权力的村民自治权的实现。本文在重构村民自治权的组织框架时,将村民自治权的运行框架定为村民大会、村民委员会、调解监督委员会这三个相互独立并相互制约的自治机关,同时增设村民常委会议强化村民大会的最高权力机构职能,厘清村民委员会的职能,提高调解监督委员会的地位,将其确定为村民大会下设的与村民委员会并行的机关。The realization of villagers＇ autonomy rights relies on the organized frame of villagers＇ autonomy. The dispute case of fixing the water electrical power station in Zhongdong Village, Jinshi＇ Xing＇an County, Guangxi Province exposed the defects of cttrrent operation of villager autonomy such as the over- concentrated power in villager committee＇s hand in the system of Villager Autonomy, and the lack of restrictions on power, etc. Such defects are exactly the roots which led to the villager committees＇ infringement on the villagers＇ fight. The theory ＂The rational distribution of power and inter - restriction is the precondition of the regular operation of power ＂ , which is applied to the process of realizing the fight of shareholders in modem corporation systom is also applicable to the realization of the villager autonomy fight, as a social public fight. When restructuring the organized frame of the villager autonomy right, the thesis separates the operational frame into three independent and inter - restricted Villager Meeting, Villager Committee, Mediating and Supervising Committee. Mean - while, establishes the Villager Standing Committee to strengthen the function of Villager Committee as the super power organization, clarifies the function of Villager Committee, and improves the position of the Mediation and Supervision Committee as the organ under the Villager Meeting and parallel with the Village Committee.
