摘　　要：保险法中,法律基于损失补偿原则设立了代位与委付法律制度,重在保护保险人的利益,而不至于使被保险人获得超出其实际损失的赔偿。反思代位与委付法律制度法理依据,可知代位与委付法律制度存在之法理有待商榷。In the law of insurance, the system of subrogation and abandonment has been set up according to the principle of indemnity, aiming at protecting insurance company＇s benefit from paying more than actual loss. The paper holds that the theoretical basis of law of the system of subrogation and abandonmect should be re-discussed.
