摘　　要：法律意味着秩序,宗教意味着信仰。没有法律,人类便无法维系当下的社会;失去信仰,人类则无以面对未来的世界。在所有已知文化当中,都存在着法律价值与宗教价值的相互作用,都存在着宗教神性和法律理性的相互影响。西方宗教神性与法律理性互动先后经历了由契合到冲突再到和谐的历史轨迹:远古时代,西方宗教神性与法律理性往往是混同合一的,法律理性借助于宗教神性得以展开;到了中世纪末期,宗教神性与法律理性不断冲突,法律理性从宗教神性中分离出来;然而两者的长期分野却使西方人陷入了空前的精神危机,迫使两者重新融合,并达到全新和谐,来共同维护社会秩序、实现社会正义和推动法治进程。西方宗教神性与法律理性辨证互动的历史轨迹为当代中国的法治发展提供了借鉴:中国的法治建设不仅需要进行制度上的建设,而且需要对整个政治文化、法律文化进行重构,只有二者相结合才能取得良好效果。The law means the order. The religion means the faith. Without law, the mankind cant support social order. Without the faith, the mankind cant face the future world. At all cultures , there is the interaction between the law value and the religion value, there is the mutually influence between the religious divine nature and the law logos. The history tracks of dialectical interactive movement between the western religious divine nature and the law logos： Combine, Conflict and Harmony. At ancient times, the westem religious divine nature and the law logos usually combine together. The law logos is the expandedness of the religious divine nature. At the last Middle Ages, the religious divine nature has been come into conflict with the law logos continuously, the law logos has been separeted from the religious divine nature. However, the long - term abruption made the occidental sank into the unprecedented spirit crisis, the western religious divine nature and the law logos had to introject again, and arrived at the new harmony. The harmony can vindicate the social order and realize the social justice and push the rule of law. The history track of dialectical interactive movement between the westem religious divine nature and the law logos may be used for regerence in the rule of law in contemporary China： the rule of law in China must not only carry on the system construction but also rebuild the whole political culture and the law culture to obtain good result.
