摘  要:《消法》第四十九条规定的双倍赔偿是否能适用于商品房交易一直都有争议。本文通过法理分析,原则上肯定了双倍赔偿可适用于商品房交易,并从建筑的技术经济特点出发,分析了适用的原则、范围和方式。同时指出双倍赔偿适用于商品房交易对规范我国房地产业的积极意义,以及最高法院新近的司法解释关于双倍赔偿的规定的不足。Whether Double Compensation prescribed in the 49^th provision of Consumer Law is applicable to the market house business is being disputed. This essay affirms in principle that Double Compensation is applicable to the market house business through jurisprudence analysis. Basing itself on the technical and economical characteristics of the architecture, it also analyzes the principle, scope and measurements of the applicability. Moreover, it indicates the positive meaning towards regulating the real estate business in China, if Double Compensation is applied in market house business, and deficiency of the judicatory commendation issued lately by the Supreme Court concerning Double Compensation.
