摘　　要：随着《中华人民共和国环境影响评价法》《环境影响评价公众参与暂行办法》的颁布施行,环境影响评价中的公众参与有了明确的法律依据。但当前环境影响评价中公民参与权的内容还不具体,并且没得到有效的保障,因此应明确公民参与权的性质、内容和程序,扩大公众可以参与评价的范围,保障利害关系人的平等参与,保障公民参与权。With the promulgation and implementation of ＂The Code of PRC Environmental Impact Appraisal＂ and ＂Provisional Rules of Public Participation in Environmental Impact Appraisal and its Procedures＂, the public＇s participation in environmental impact appraisal obtains a definite legal grounds. But at present, the citizen＇s participation right has no crystallized content and hasnt been defended effectively. To ensure the implementation of citizen participation rights, it is necessary to define the character and content and procedures of citizen participation fights, extend the allowable appraisal range, and ensure the actual participation right of interest-related parties.
