摘 要:辩析了相关法律法规对环境影响评价公众参与问题规定的不同,分析其利弊.在此基础上,提出建设项目环境影响评价公众参与应由第三方实施——在环境保护部门内设置公众参与工作室,由公众参与工作室全程负责建设项目的公众参与工作,能有效地克服实施者为建设方或评价单位的弊病,充分发挥公众参与的作用.The different regulations made by laws and codes to this kind of problems and analyzed its advantages and disadvantages were discussed. On this basis, it advanced that the subject of public participation of environmental impact assessment of construction projects should be carried out by the third side which was set up in the environmental protection department, who should be in charge of this job of public involvement. By this way it could overcome the disadvantages made by the construction project or the departments of environmental assessment , and exert the impact of public participation adequately.
