摘　　要：随着行政理念的不断更新,行政指导作为非强制性的事实行为被应用到实践中。行政指导方式与环境保护的结合是基于环保理念和行政指导的互融性、共通性的必然趋向,这是行政指导得以应用于环保领域的理论依据。对其法律依据的思考不能过多地拘泥于行为法的限制,而应该更多地强调对其权限、程序等方面的合理规制以及对相应责任的规定,以期环境行政指导能在法治轨道上顺利运行。With the renewal of administrative concept, as a modem administration patterns administrative guidance has been applied, Because of the feature of environmental problem, there is vast space for the appliance of administrative guidance. The combination of administrative guidance and environmental protection is based on the generality of the environmental conception and administrative guidance. And we should analyze the legitimacy modem of the environmental administrative guidance, this is also its legal foundation.
