“农地年薪制”+“土地换社保”新型征地补偿方式的可行性探讨——以陕西杨凌农业高新技术产业示范区为例

摘　　要：从土地具有基本的生产资料和生活保障功能的特点出发,提出了传统征地补偿方式存在的缺陷;接着以陕西杨凌示范区为例,从土地的功能和失地农民有关的生活保障、子女上学、合作医疗、养老、就业等方面出发构建新型征地补偿方式。通过对一次性征地补偿和新型征地补偿两种方式现值的比较,完善了原有征地方式中因土地增值和农民生活保障等问题的不足,并分析了新型征地补偿方案的可行性。From the viewpoint of the basic productive material and social security function of the land, the shortage of the traditional compensation of the land for the farmers was put forward and the lose of the farmer in the process of the land production and the social security function were not reasonably reflected. The Yang Ling Hi - tech Agriculture Zone of Shanxi province taken as the example, the life insurance, the children education, the cooperative medical treatment, the old-age pension, employment and so on should be embarked in the new compensation. The disposable compensation was compared with the establishment of new compensation in order to explore the current value of comparison, and then, the insufficiency in the original draft without the land multiplication for farmer social security was consummated. Finally the feasibility of new draft of the compensation was analyzed.
