摘　　要：使用人责任是侵权责任法的基本类型,我国制定侵权法应予规定。使用人责任从总体而言,是自己责任,其被用者“执行职务”应采外形理论。使用人与被用人之间是不真正的连带债务,使用人对被用者的追偿应限于被用者的重过失。The user＇s liability is the basic type of the Tort Liability Law which should he speculated in our Tort Liability Law. Generally speaking, the user＇s liability is his own responsibility, and the used should adopt external theory ＂in the implementation of the duties＂, It is not the real joint debt that exists between the user and the used, and the compensation for the used is supposed to be the gross negligence of the used.
