摘　　要：美国《1974年贸易法》421条款是专门针对中国进口产品的特殊保障措施条款,该条款具有歧视性并违背了WTO的基本原则,且操作随意性大,可能极大地威胁我国的出口贸易。为将负面影响降至最低,我们必须深刻理解该措施的内容及实施机制,加快制定我国相关法律,完善各项磋商、谈判、监督的制度,更好地应对特保措施。Clause 421 of U.S. Trade Act of 1974 is about the special safeguard enforcement to China. This kind of stipulation obviously breaks the principle of non- discrimination. Furthermore, it is common that enforcing it at will, which exerts a very negative impact on China＇s export. In order to resist the jeopardy, we must comprehend deeply the substance and implementation mechanism of the special safeguard enforcement; on the other side, we also have to make relevant regulations and rules, improve the system of consultation, negotiation and supervision with the other members of WTO.
