现行民族自治地方自治权实现之困境及对策探讨——基于法理学的视角

摘　　要：民族自治地方自治权既是民族区域自治的核心内容,也是各少数民族管理本民族内部事务和地方性事务的主要标志。但目前我国民族自治地方自治权的实现还面临着法律体系不完善、法律内容不健全、法律实效不强、法律结构不合理、法律体系内部不协调等问题。新时期要真正实现民族地方自治权,首先要形成民族地方自治权的法意识,同时还要进一步完善民族自治法规体系,加大对相关法律法规的执行力度。Autonomy of national autonomous areas is the key component of regional aulonomy of ethnic groups and the symbol of ethnic groups handling their own affairs. To achieve autonomy of national autonomous areas, there exist such problems as imperfectness of legal systems and legal conlenl, lacking of invalidity of the law, and the legal structure being unreasonable. In this new era, in order Io achieve autonomy of national autonomous areas, it is necessary to develop the consciousness of autonomy of national autonomous areas, improve the legal system of national autonomy and strengthen enforcement of related laws and regulations.
