体育法学研究中法治浪漫主义思潮探析

摘　　要：我国体育法学研究中存在着法治浪漫主义,通过分析看出,体育法学研究折射出的法治思想中存在一些浪漫和理想的成分是合理的,也是必要的,对于体育法治建设具有积极的意义。但是问题也不容忽视,主要表现为法律万能、泛法治主义的思想,体育法学研究者应该激情与理性并存,树立体育控制的大局观,以期用先进、正确的理论研究指导体育的法律实践。Romanticism of Rule by Law exists in the researches on sports law. From the analysis, it was reasonable and necessary that there were some elements of romance and ideas in the thoughts of law reflected from the research on sports law, which was benefit to the sports law construction. But the problems was also serious, the main expression of these problems wass the thoughts of law being all-powerful and pan-ride-by-law. The researchers should connect romance with reason, establish the general situation consciousness of sports control, so as to direct the legal practice with the advanced and correct theoretical research.
