摘　　要：虽然《物权法》草案中没有确立留置权的善意取得制度,但鉴于留置权本身的特征以及我国现实生活的需要,应该设立留置权善意取得制度。留置权的善意取得有其独立的构成要件。In accordance with the characteristics of lien and the need of real life in China, the author holds that the system of lien acquisition in good faith should be set up,aulthough it has not been written in the draft of real rights law. The acquisition in good faith of lien has its composing element.
