摘  要:This essay focuses on the Transitional Products- Specific Safeguard mechanism (TPS clause), Section 16 of China's Protocol on Accession to WTO and the conflicts between the TPS clause and the WTO law. The TPS clause carries out selective safeguard mechanism prohibited by GATT, adopts the concept of "market disrupt", permits application of gray measures and allows relative member states taking unilateral acts. Furthermore, trade diversion created by the TPS clause could bring a vital attack to Chinese industries. The TPS clause with those features can ruin not only Chinese economic development but also the effectiveness of WTO system. China must do best to minimize the negative impact that the TPS clause may cause to Chinese economy and WTO regime.
